You stated yourself that overturning all marriages in favor of civil unions is highly unlikely.
If they were *exactly* the same thing, nobody should have a problem trading one in for the other.
Which per force then makes them two separate things. How you personally view it is irrelevant -- it is how the law interprets it.
And no, in California, civil unions do not carry the same legal weight as marriages.
