The story says the judge has refused to hear the defense; but the fact it was put forth by a tenured college professor in Portland, OR - and hasn't been challenged by anyone....

I'd hate to be that lawyer. No lawyer capable of passing the bar exam would put on a defense like that if there was a better option.

About a hundered years ago that defense might have been somewhat reasonable...

The article states that the defendant "had a traditional, Southern, small-town, working-class upbringing where 'whuppin' was accepted." Shouldn't they look at the culture of the last 40 years, rather than listening to stories from 150 years ago?

No, I don't like slavery. No, I don't think white supremicists are right. No, I don't think it was right to force millions of Africans to the Americas to harvest crops.

But I don't feel *directly* responsible for it, any more than I feel directly responsible for the sacking of Lindesfarne (Danes) the French Revolution (Normandy) or the Holocaust (Dutch-German.)

Neither do I feel suppression from Edward Longshanks (Welsh and Scots) or from Hastings (Saxon-English.)
