Just got an email blast from preschool:

Hello again everyone!

I just received my call from Upsorn. I told her about the silent auction and we have really good news for you all. Upsorn says “YOU OWN ME!” So we are offering Upsorn coupons in our upcoming silent auction! Yes you heard it right, we are selling Upsorn!! She is very happy; it was great to hear the hope in her voice. She wrote a letter to the parents and to the staff and mailed them on Monday. We should get them soon. She wanted to express her love and appreciation to you all for how much you have done for her. She misses everyone sooo much!

We are still being patient as we do not have any news yet from El Paso. She did talk to the officer involved in her case (sounds like they had 2 meetings) and he asked about her education and where she is from. She told him she has her Master’s degree in Education from Oklahoma and is from Thailand. He informed her that because her 2 sons are US born, that will help. Then her attorney also mentioned that we may be able to do a “work sponsor” program.

So keep up the positive thoughts and prayers everyone. Hope we get an answer soon!

Read this: http://www.visapro.com/Change-of-status.asp

If the application is not timely filed, USCIS has the discretion to excuse the late filing if the applicant can show that:

a. the late filing was due to extraordinary circumstance beyond the control of the applicant, and that the delay was commensurate with the circumstances;

b. the applicant has not otherwise violated their status (e.g., has not engaged in unauthorized employment);

c. the applicant remains a bona fide nonimmigrant; and

d. the applicant is not in removal proceedings.

The other thing I found was that if she was out of status for 180 days or more she would be banned for 3 years only. Less then 180 days and not sure, but she should be okay. 365 days out of status and she'll likely end up with a 10 year ban. Having the kids here, she can use them as anchor babies. (shrugs). She has a college degree so she's obviouslly not an idiot, therefore how am I suppose to feel sorry for her not doing what she needs to do?

The lady who took care of my Mom for seven years was here as a refugee from Honduras. So she was here legally, and could work, but if she left the country to visit her Dad, she'd be refused reentry. Eventually she fell in love with my stepbrother, and they got married and she got her green card. I ended up helping financially with that because EGADS is that process expensive, and then she ended up taking care of Alex for the first 2 years of his life.The process is complicated and pricey, I wish it were easier.
