If government funds were used to pay for abortions, you'd have the records already, dumbass.

Like, oh, anywhere else in the free world, maybe? Ask Canada. Ask Denmark. You want statistics on abortions? They can give it to you in minutes - they have everything in the database. Oh, you want identifying information? Sorry, no. The proper authorities have already been there, dealt with the matter and you really don't need that information, do you?

You'd have *gasp* statistics and information that would help you formulate a plan to prevent this from happening in the future! You'd know what kinds of demands women have on needing abortions - and you'd have all the information you'd need to go after those stinking pedophiles and child rapists and...stuff.

No. You just gotta have someone to hate. Otherwise, you never gave a damn in the first place. People are so freaked out over any private information leaking out because, well, you never fucking know what they are going to use it for...certainly nothing to the subject's benefit.

Stuff like this never saved a child or stopped a rape. Think about it. They're spending funds on punitive actions that don't prevent a thing or save a single underage child or sick, pregnant adult.

And the underage young women...a number of whom may well now be over the age of consent, and carrying on with their lives...who may have marriages, families, school, ect, ect. NOW have to worry about someone knocking at their door and demanding to know intimate details of the thing they may well be trying to get over. What a wonderful government we have. Not to mention women who had medical problems, went through hell with a late term abortion, and are also trying to cope having their reasons, sanity, and motives questioned.

This is clearly a fishing expedition. However, there is a legitimate state interest in investigating statutory rape or elective late term abortions (a crime in Kansas past 22 weeks). There is no good reason, however, for the clinics to have to divulge detailed medical records. The request should have much greater specificity.

*nods* I can see a reason for gathering the statistics, and find that understandable. But giving out the actual details that would (if I'm reading the article correctly) set the women up for harrassment and single them out is just wrong. I also wonder how the Federal HIPPA regulations play into that? I got out of the health care field just prior to them being enacted, but so far as I remember, even family members aren't privy to that information unless the patient grants them that right. I suppose there's a loophole there that lets the government get it's claws in.

Ewwwwww, this is sick. They're USING rape/incest victims to justify their prying. That's evil! And clever...because if you protest this, then clearly you're in favour of child rape. Ugh, damnit, these people are driving me crazy.

I just had a rant the other day about how it's amazing how many of these anti-abortion folks are in it to "save babies" but are willing to deny free prenatal care for all pregnant women. If that doesn't spell it out that this is about domination over female reproduction and NOT about saving babies, I don't know what does.

I'm so sick of this crap. Can the pendulum start swinging back the other way soon, please? Pretty please? *sigh*

I agree completely here. And what is with the prosecuting underage kids who have sex??? Belive me, I started having sex at 15 and it's because i felt alienated and alone, and was insecure as hell. I latched on to one of my peers who showed me any sort of approval and affection. I'm sorry, proscuting me because of that??/ How about prosecuting the girls I went to school with and their cruelty that saw me running to the bathroom and crying during class? [grumbles about iditos]

It is near impossible (if not impossible, but I don't want to say that...) to get a late term abortion in Canada. Except for a few clinics in very big cities like toronto and montreal, all abortions are done in hospitals, and hospitals aren't going to lose parts of their licenses. In fact, neither are the clinics.

What a joke. A reasonable doctor would not provide an abortion beyond the first trimester in the first place, because if a single soul were to find out about, the doctor in question could be charged with a host of criminal allegations, not to mention being sued in tort by parents of said underage teens.

Aside for that, I would assume that in cases of incest there are enough statutory laws in place where the doctor can report said abuse to the authorities without breaching too much confidentiality.

There are clear cut exceptions to a doctor-patient's confidentiality privilege (that's right, it's a legal privilege), but they hardly ever involve disclosing more than is sufficient to protect a patient.

Even if no appeal has been scheduled, it's not unlikely that an order for injunction (that is, to stop him from getting his mittens on those files) pending review has also been filed. Barring that, the doctors themselves can elect to refuse turning over those records even if a judicial order says so (it wouldn't be the first or last time a doctor has had to do that). As for obtaining a review, the District Judge in question obviously disregarded a host of federal laws about privacy and confidentiality, so I would be shocked if an appeal was refused.

I just feel sorry for the victims of this abuse of power, because they have to live with the fear of being criminalized by this bully. There is no other word that bars a copious amount of cursing attached. >_

umm.. this has to be some sort of massive violation of a patient's right to privacy, not to mention medical consent, etc. i know that here the doctors won't even write us 'sick notes' for class because they consider it a violation of our rights... (we have to go to the deans instead.) This is just an extremely obviously thin plot to harass both providers and the poor women who have had abortions.

it's also hardly suprising.
